This web site (the “Site”) is published and maintained by Jagadish Air Travels Pvt Ltd (Jagadish Tours), a company incorporated and existing in accordance with the laws of the Republic of India. When you access, browse or use this Site you accept, without limitation or qualification, the terms and conditions set forth below. When you access any sub-site (whether belonging to an ‘associate’ of Jagadish Tours or otherwise) through this site, then such sub-site may have its own terms and conditions of use which is specific to such sub-site. Sub-sites may contain such additional terms and conditions of use as may be set out in such sub-site.
These Terms and Conditions of Use and any additional terms posted on this Site together constitute the entire agreement between Jagadish Tours / Jagadish Air Travels Pvt Ltd and you with respect to your use of this Site.
The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Jagadish Tours The User further consents that the terms and contents of such Privacy Policy are acceptable to him.
The user agreement incorporates the terms and conditions for Jagadish Tours to provide services to the User of this website (”the User”) and any person(s) availing services from Jagadish Tours through this website shall be deemed to have read, understood and expressly accepted these terms and conditions, which shall govern the desired transaction or provision of such services by Jagadish Tours for all purposes, and shall be binding on the User. All rights and liabilities of the User and/or Jagadish Tours with respect to any services to be provided by Jagadish Tours shall be restricted to the scope of this agreement.
Jagadish Tours reserves the right, in its sole discretion, to terminate the access to any or all Jagadish Tours websites and the related services or any portion thereof at any time, without notice.
The User, by using the service and accessing the website www.jagadishtours.Com authorizes Jagadish Tours and its agents to access third party sites designated by them or on their behalf for retrieving requested information, thereby appointing Jagadish Tours. Command its agents as their agent for this purpose.
Always the User expressly undertakes to provide to Jagadish Tours only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from Jagadish Tours. In case Jagadish Tours discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, Jagadish Tours in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, Jagadish Tours shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services. The User unequivocally indemnifies Jagadish Tours of any such claim or liability and shall not hold Jagadish Tours responsible for any loss or damage arising out of measures taken by Jagadish Tours for safeguarding its own interest and that of its genuine customers.
Jagadish Tours has endeavored to ensure that all the information provided by it is correct, but Jagadish Tours neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information. Jagadish Tours makes no warranty, express or implied, concerning the website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of any such information.
Jagadish Tours reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the services. Jagadish Tours further reserves the right to alter any and all fees from time to time, without notice.
The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services.
In case, there is a short charging by Jagadish Tours for listing, services or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion.
To the extent Jagadish Tours acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the user as regards the standards of services provided by the service providers. In no circumstances shall Jagadish Tours be liable for the services provided by the service provider.
Jagadish Tours is responsible only for the transactions that are done by the User through Jagadish Tours. Jagadish Tours will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User. The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction.
In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular Jagadish Tours website, then these terms shall control.
Jagadish Tours is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages. Jagadish Tours does not endorse any advertiser on its web pages in any manner. The Users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

The User expressly agrees that use of the services is at their sole risk. The services are provided on an “as is” and “as available” basis. Jagadish Tours expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Jagadish Tours at its sole discretion reserves the right not to accept any customer order without assigning any reason thereof. Any contract to provide any service by Jagadish Tours is not complete until full money towards the service is received from the customer and accepted by Jagadish Tours.
User acknowledges that Jagadish Tours provides services with reasonable diligence and care. It endeavors its best to ensure that User does not face any inconvenience. However, the User agrees and accepts that in exceptional situations due to any technical or other failure, services committed earlier may not be provided or may involve substantial deficiency. In such cases, Jagadish Tours refunds the entire amount received from the customer for availing such services minus the applicable cancellation, refund or other charges, which shall completely discharge any and all liabilities of Jagadish Tours against such non-provision of services or deficiencies. Additional liabilities, if any, shall be borne by the User.
Without prejudice to whatever is stated above, the maximum liability on part of Jagadish Tours arising under any circumstances, in respect of any services offered on the site, shall be limited to the refund of total amount received from the customer for availing the services less any cancellation, refund or others charges, as may be applicable. In no case the liability shall include any consequential loss, damage or additional expense whatsoever beyond the amount charged by Jagadish Tours for its services.
In no event shall Jagadish Tours and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Jagadish Tours website(s). Neither shall Jagadish Tours be responsible for the delay or inability to use the Jagadish Tours websites or related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the Jagadish Tours website(s), or otherwise arising out of the use of the Jagadish Tours website(s), whether based on contract, tort, negligence, strict liability or otherwise. No advice or information, whether oral or written, which the User obtains from Jagadish Tours or through the services shall create any warranty not expressly made herein or in the terms and conditions of the services. In case the User is not satisfied with any services provided under this site or any portion of the Jagadish Tours website(s), or with any of these terms of use, their sole and exclusive remedy is to discontinue using this site after notifying Jagadish Tours in writing.
The customer is aware that Jagadish Tours provides various services like hotel bookings, car rentals, holidays and would like to learn about them, to enhance his / her travel experience.
The customer hereby specifically authorizes Jagadish Tours to contact the user with offers on various services offered by it through direct mailers, e-mailers, telephone calls, short messaging services (SMS) or any other medium, from time to time. In case that the customer chooses not to be contacted, he / shall write to Jagadish Tours for specific exclusion.
Jagadish Tours may provide the User with contents such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws. The User may use this material only as expressly authorized by Jagadish Tours and shall not copy, transmit or create derivative works of such material without express authorization.
The User acknowledges and agrees that he/she shall not upload, post, reproduce, or distribute any content on or through the Services that is protected by copyright or other proprietary right of a third party, without obtaining the permission of the owner of such right. Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.
Jagadish Tours reserves the right to change the terms, conditions, and notices under which the Jagadish Tours websites are offered, including but not limited to the charges. The User is responsible for regularly reviewing these terms and conditions.
Unless otherwise specified, the Jagadish Tours websites are for the User’s personal and non – commercial use. The User may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Jagadish Tours website(s) without the express written approval from Jagadish Tours.
The terms and conditions herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine, feminine and neuter form. The words “include”, “includes” and “including” shall be deemed to be followed by the phrase “without limitation”. Unless the context otherwise requires, the terms “herein”, “hereof”, “hereto”, ‘hereunder” and words of similar import refer to this agreement as a whole.
The User agrees to indemnify, defend and hold harmless Jagadish Tours and/or its affiliates, partner websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Jagadish Tours and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement.
You may travel to certain destinations which involve greater risks than others, entirely at your risk as to cost and consequences.
Jagadish Tours requests you to consult your local authorities and evaluate travel prohibitions, warning, announcements, and advisories issued by them before booking travel to certain international destinations.
By offering for sale travel to particular international destinations, Jagadish Tours does not represent or warrant that travel to such point is advisable or without risk. Jagadish Tours does not accept liability for damages, losses, or delays that may result from improper documents for entry, exit, length of stay, or from travel to such destinations.
Jagadish Tours reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any material posted herein, in any respect. Jagadish Tours shall have no obligation to take the needs of any User into consideration in connection therewith.
Jagadish Tours reserves the right, in its sole discretion, to terminate the access to the website and the related services or any portion thereof at any time, without notice.
The products and services displayed on the Site may not be available for purchase in your particular country or locality. The reference to such products and services on the Site does not imply or warrant that these products or services will be available at any time in your particular geographical location. You should check with your Jagadish Tours authorized representative for the availability of specific products and services in your area.
You will have to limit yourself as per normal baggage policy of the airlines in the respective class that you have chosen to fly. Any excess baggage that you carry shall remain your responsibility. Any loss of baggage by the airlines or the passenger will be the sole responsibility of the airline and the passenger. Normally economy class 5-20kgs is permitted however if you are traveling to US/ Canada you are permitted to carry 2 pieces as check in and 1 piece as cabin baggage. You are requested to kindly refer to the baggage rules of the individual airlines as the same gets updated from time to time. It is advisable that the passenger acquires adequate insurance cover to secure their life health and property. You can purchase the same from our site. Your health and good life is of utmost importance to us.
Jagadish Tours reserves the right to determine the amount of refund value incase of cancellation and amendments. The decision on the quantum of refund will be final as that made by Jagadish Tours. The refund will be made in the name of the client. Incase you have booked through Jagadish Tours website still we will make the refund in the passengers name. It will take at least 45 days to process refunds for all services. There will be no refund for unutilised services unless specified. All cancellation and amendment charges will be applicable as per principles policies on which Jagadish Tours has no control and you will be subjected to it.

The products and service statements on this Website are for general description purposes only. Furthermore, not all the products or services are available in every state or country. a. Hotels: While booking a hotel please carefully go through the fact sheet in details to ensure that the amenities present are as per your requirement. Jagadish Tours generally updates all these fact sheets however it is dependent on the hotel to provide updated information. Renovation at hotels is normally undertaken at sole discretion of hotels and not necessarily is informed to us. Incase of any dispute Jagadish Tours shall not be liable for a disruption in information.
b. Sightseeing: You have a choice of seat in coach sightseeing and private sightseeing tours. Please choose the same carefully. Panoramic tours do not allow you to stop at the site of the attractions. You will have to follow a schedule. Entrances to attractions are not included in city tours unless specified.
c. Airlines: You have a choice of full service and low cost airline options. Low cost airlines do not have all services available on board hence please choose the airlines carefully before booking. Kindly go through the fare rules and also select your class of travel. There are paper tickets and/or e-tickets that will be provided to you. Both are valid to travel by the airlines. However certain airlines do not entertain e-tickets. In such cases you will be issued paper tickets. We are only an intermediary party hence cannot be held responsible for any delay or cancellation of flight or change of route – a decision taken by the airline. You will be subject to all terms and conditions as per the airlines.
d. Holidays: Please refer to inclusions and exclusions carefully before booking. You can customize your holiday completely if our website packages do not meet your requirements.
e. Rail and Cruises: Please refer to individual rules applicable against both rail and cruise providers. These rules will be applicable for each transaction made through us.
Jagadish Tours is a travel and holiday organizer. We do not control or operate any airline, neither do we control or own any shipping company hotel or transport or any other facility or service mentioned on the site. We take care in selecting all the principles however but because we select them- we have no control on running them. We cannot be held responsible for any lack of service by any independent agency airline transport hotel or any other service provider.
If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.
This agreement and each user agreement /terms of service shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Bangalore,Karnataka State in India.
